1. Our no-refund policy
HoneyBerry AI does not offer voluntary refunds. Subject to mandatory law and any express right in your accepted agreement, payments for subscriptions, onboarding, configuration, integrations, and other agreed work are non-refundable.
This means we do not ordinarily refund a change of mind, unused subscription time, unused usage, a decision to stop using the service, or a change in your business priorities. Please review your proposal, scope, and payment schedule before accepting.
This policy does not exclude a refund, cancellation, repair, repeat performance, price reduction, compensation, or other remedy you are entitled to by law. It does not allow us to retain money unlawfully, charge without authorisation, or avoid responsibility for a service that does not meet a mandatory legal guarantee.
2. Cancelling your service or renewal
To cancel, email hello@axyva.com or use your agreed support channel. Include the account or business name, the service involved, and the renewal or end date you are asking about. No special wording is required.
The effective date, remaining access, and any existing minimum commitment follow your accepted agreement and applicable law. Cancelling a renewal stops future renewal charges when the cancellation takes effect; it does not ordinarily refund the current period. Cancellation cannot remove a statutory right to terminate earlier or recover a payment.
Where an applicable law requires a particular online cancellation method, reminder, or notice period, that requirement takes priority. Deleting a messaging app or disconnecting an integration does not by itself communicate a cancellation to us.
3. Billing errors and service problems
Tell us about a duplicate or incorrect charge, an unauthorised payment, non-delivery, or a service that does not match the agreed scope. Include the invoice or transaction reference and a short description. Please do not email full payment-card details, passwords, or unnecessary personal information.
We will assess the issue against your agreement and applicable law, explain the outcome, and provide any remedy required. A valid statutory claim is not restricted by the voluntary no-refund policy or an artificial claim deadline. You retain any right to dispute a payment through your provider or complain to an authority.
4. Mandatory rights by region
European Union
If you buy as a consumer, an online service contract will generally have a 14-day withdrawal period beginning when the contract is concluded, subject to applicable exceptions. Starting a service during that period requires the express request and information required by law. Any lawful payment for work already performed must be proportionate. A service withdrawal right is not lost merely because you log in or accept general terms; the conditions for full performance or any other exception must actually be met. Mandatory remedies for a digital service that is not supplied or does not conform also remain available.
Australia
Where the Australian Consumer Law applies, services must meet its consumer guarantees. Depending on the failure, you may be entitled to have a problem remedied, cancel, receive a refund for the relevant unconsumed services, or claim compensation. These rights can also apply to qualifying business purchases. We do not exclude them through a no-refund policy.
New Zealand
Where the Consumer Guarantees Act applies, you keep its service guarantees and remedies. A failure that cannot be remedied or is of substantial character may permit cancellation and a refund. This website policy does not contract out of those guarantees.
United States and India
Applicable federal, state, and Indian consumer laws may provide rights concerning misleading claims, unauthorised billing, non-delivery, deficient services, recurring charges, and unfair terms. Any mandatory cancellation or refund right prevails over this policy. The policy does not waive rights under India's Consumer Protection Act, 2019 or other applicable law.
5. When a refund is required
If a refund is required by law or your accepted agreement, we will arrange it within the applicable legal deadline, ordinarily to the original payment method unless another lawful method is agreed. Payment-provider processing time may affect when the credit appears; it does not extend our legal obligations. A service credit will not replace a cash refund where you are legally entitled to a refund.
6. Exercising an EU consumer withdrawal right
Where a withdrawal right applies, send a clear statement to hello@axyva.com before the withdrawal period ends. You may use the following wording, but you do not have to:
To Axyva eSolution Private Limited, Tejaswini Housing Society, Next to Medipoint Hospital, Aundh, Pune, India 411067; hello@axyva.com.
I/We give notice that I/we withdraw from my/our contract for the following service: [service].
Ordered on: [date]. Consumer name(s): [name]. Consumer address: [address]. Date: [date]. Signature: only if sent on paper.
If the applicable withdrawal right is exercised, reimbursement will be made within its legal deadline, generally within 14 days after we receive the withdrawal notice, using the original payment method unless expressly agreed otherwise and without an additional reimbursement fee. Any lawful deduction for requested work already performed must satisfy the requirements described above.
